Trademarks in Poland and the EU

A brand is worth what you can defend. We search before you file, choose the right register for your market, and act when someone copies your name.

Who this is for

Companies entering the Polish or EU market, brand owners facing copies in Poland, and businesses whose name or logo is not yet protected.

What we do

01 · Search and strategy

Identical and similar earlier marks in Poland and the EU, risk assessment, and the choice of register: UPRP, EUIPO or WIPO (Madrid).

02 · Filing and prosecution

Drafting the list of goods and services (where most filings are won or lost), filing, answering office objections, monitoring until registration.

03 · Oppositions and invalidity

Opposing applications that collide with your mark and defending your filings against oppositions by others.

04 · Enforcement

Cease-and-desist letters, infringement and unfair-competition claims, cooperation with marketplaces and customs.

Experience

Dr Tomasz Gulla has registered more than 40 trademarks for clients and for his own firm: GULLA® is a registered trademark.

How it works

  1. Brief. Your name, logo, products and target markets.
  2. Search report with a recommendation and a fixed quote.
  3. Filing. We handle the procedure and keep you informed.
  4. Watch. Optional monitoring of new filings that may conflict with your mark.

Fees

Fixed fees for searches, filings and standard office actions; official fees passed on at cost. Disputes by fixed fee or hourly rate.

Questions, answered.

Polish trademark or EU trademark?

An EU trade mark registered with the EUIPO covers all EU Member States with one filing, but it can be blocked by an earlier right in any of them. A Polish trademark registered with the UPRP covers Poland only and can be cheaper and easier when Poland is your only market. We recommend the route after a search.

I already have a trademark outside the EU. Can I extend it to Poland?

Usually yes, through the Madrid System administered by WIPO, designating Poland or the European Union. We check the classes and the wording of goods and services before the designation.

Someone registered a name similar to mine. What can I do?

Depending on timing: file an opposition against the application, request invalidation of the registration, or bring an infringement or unfair-competition claim. The first step is to secure evidence of your earlier use and rights.

How long does registration take?

It depends on the office and on whether anyone opposes. Without opposition, registration typically takes months, not years. We give you a realistic timeline for your case.
